For a complete understanding of the terms governing the use of our websites and services, please also review our Terms and Conditions, which form an integral part of this Policy.

1. WHO WE ARE

For the purposes of this Privacy Policy (the “Privacy Policy”), any reference to RFAQ is deemed to include its affiliated companies (including any subsidiaries), divisions, and other companies in its corporate group, its service providers or licensors, as well as their respective employees, officers, directors, shareholders, agents, contractors, and other representatives.

This Policy has been developed on behalf of RFAQ. Therefore, when we use the terms “we,” “our,” or “us,” we refer to the RFAQ entity responsible for processing your personal information.

Additional privacy laws may apply, particularly for individuals whose information is collected or processed within the European Economic Area (“EEA”).

This Policy aims to inform you about our practices regarding the collection, use, disclosure, retention, and protection of personal information obtained through our website or in connection with RFAQ activities.

It also outlines the measures we take to ensure its security and the ways you can access your personal information, correct it, or request its deletion in accordance with Law 25 (in Quebec) or other applicable laws.

By accessing our website or providing us with your personal information, you consent to its collection, use, disclosure, and processing as described in this Policy. If you do not agree to these terms, please do not use the website or provide us with your personal information.

2. WHEN AND HOW WE COLLECT YOUR PERSONAL INFORMATION

We collect personal information you provide to us in various ways, including:

2.1 Through direct interactions:

  • Contacting us via a form available on the website;
  • Communicating with us regarding the services and products we offer;
  • Contacting us to ask a question, submit feedback, or file a complaint (customer service);
  • Subscribing to our mailing lists, email communications, and messaging services to receive news and updates;
  • Job applications;
  • Use of social media.

2.2 Through technologies or automated interactions:

When you use our website, we automatically collect certain technical data (detailed below) about your equipment and internet browsing. Our website uses a technology called “cookies.” A cookie is a small data file that our website can send to your browser and which can be stored on your computer's hard drive to allow us to recognize you on future visits. We use cookies to understand which portions of our website are useful and which need optimization, helping us plan website improvements. You can configure your browser to be notified when you receive a cookie or to refuse certain cookies. However, if you choose to refuse our website cookies, you may not enjoy all the benefits and features of the site.

Our website may also use a technology called “web beacons” or “invisible pixels.” This technology helps us understand which pages of our website you visit. We use these web beacons to optimize and customize our website for you and other visitors.

We may also collect certain technical information about you if you visit other websites that use our cookies.

2.3 Through third parties:

We may obtain information about you from other sources, including customers, service providers, and business partners, and combine this information with the information we have collected about you.

For example, we may use third parties, such as Google, to:

  • Conduct remarketing, which involves displaying advertisements to individuals who have previously visited our website on other websites, including via Google Analytics. In such cases, third parties, including Google, may display our ads across websites;
  • Use Google Analytics features: reporting on impressions of our advertisements (i.e., the solution allows placing ads on news sites, blogs, and other specialty websites) to attract potential customers; integration with management tools for advertising campaigns, targeting, verification, and related reports; and generating demographic reports about website users and their interests;
  • Collect, analyze, and/or aggregate your personal information (such as IP address, gender, age, and user interests), including via demographic reporting, to help us understand how visitors interact with our website and improve our website, products, and services. Remarketing companies may combine first-party cookies (e.g., Google Analytics cookie) and third-party cookies (e.g., DoubleClick cookie) to (i) collect personal information; (ii) inform, optimize, and display ads based on your previous visits to our website; and (iii) determine the relationship between website visits, ad impressions, other advertising services, and interactions with those ads. These companies may also use web beacons or invisible pixels to report information about your visits to our website and linked websites for advertising purposes to measure ad effectiveness.

3. WHAT PERSONAL INFORMATION WE COLLECT

For the purposes of this Privacy Policy, “personal information” refers to any information about an individual from which that person can be identified. This does not include information that has been anonymized. We may collect, use, store, and transfer various types of personal information about you, grouped as follows:

  • Contact information including name, email address, title, phone number, mailing address, and contact preferences;
  • Any information in a résumé or similar document submitted in connection with a job application;
  • Social media data including information associated with any social media accounts you hold and related profile, such as name, username, email address, profile photo, date of birth, and gender;
  • Technical data including IP address, login data, clicks, and other related information, such as websites visited immediately before and after visiting our website, time zone and geographic settings, your Internet service provider, and other technologies on devices you use to access our website;
  • Usage data including number of visits to our websites, date and average time spent on our websites, and information on how you use our products and services;
  • Marketing and communication data including your preferences for receiving marketing from us and related third parties and your communication preferences.

For example, some information may be requested when you visit the website, including your name, mailing address, email, phone number, country of residence, and résumé, when you decide to communicate or otherwise engage with us through one of the available website channels.

We also collect, use, store, and share aggregated information, such as statistical or demographic data. Aggregated information may be derived from your personal information but is not considered personal information if it does not directly or indirectly reveal your identity. For example, we may aggregate usage data to calculate the percentage of users accessing a specific feature of our website. However, if we combine or link aggregated information with your personal information to directly or indirectly identify you, it will be treated as personal information under this Policy.

We do not collect personal information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, union membership, genetic data, biometric data for unique identification, health data, or sexual life or orientation data.

Consequences of refusing to provide certain personal information:

When we are required to collect personal information under the law or a contract with you, if you do not provide such information upon request, we may be unable to fulfill the relevant contract. In that case, we may need to cancel the delivery of a product or provision of a service you requested to the extent your refusal prevents us from fulfilling our obligations, but we will inform you at the appropriate time.

4. HOW WE USE COLLECTED PERSONAL INFORMATION

4.1 General principles:

  • We limit the collection of personal information to what is reasonably necessary to achieve the purposes for which it is collected. Most often, we will use your personal information under the circumstances described below.
  • With your consent: for example, we will obtain your consent before sending marketing communications;
  • When necessary to perform a contract we are about to enter or have entered with you: performing the contract means processing your personal information when necessary to perform a contract to which you are a party or to take steps on your behalf prior to entering such a contract;
  • When necessary for our legitimate interests (or those of a third party) provided your fundamental rights do not override these interests: a legitimate interest means RFAQ’s interest in running and managing our business to provide you the best service or product. We consider and adjust any potential impact on you (positive or negative) and your rights before processing personal information for our legitimate interests. We do not use your personal information for activities where our interests are overridden by your impact unless we have your consent or are legally required or permitted to do so. You can obtain more information on how we assess legitimate interests versus potential impacts by contacting our Data Protection Officer.
  • When necessary to comply with a legal obligation: complying with a legal obligation means processing personal information as required by law.

4.2 Purposes for which personal information is collected:

The personal information we collect may be gathered or used by all RFAQ entities and individuals listed above and may also be shared internally to adequately respond to your requests, communicate with you, or assist you for the purposes described in this Privacy Policy.

We describe below the ways we intend to use your personal information and the legal grounds for doing so. We have also identified legitimate interests, where applicable. Note that we may process your personal information for more than one legal ground, depending on the specific purpose. Please contact our Data Protection Officer for details on the specific legal basis for processing your personal information.
